Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the PhoSplit iOS application (the "Service") operated by BoardTack ("us", "we", or "our"). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
PhoSplit lets you split a photo into a grid of up to 5 by 5 pieces for Instagram and similar photo feeds, apply photo filters, add text or image watermarks, organize your projects with tags, and save or share the results. All processing happens on your device. You are responsible for the photos you choose to edit and for having the right to use, modify, and share them.
The Service is free to download. The free version lets you create up to 12 projects, includes a small PhoSplit watermark on saved photos, and offers a limited set of filters. Premium removes the watermark from saved photos, lets you edit and customize your own watermark, unlocks all filters including filters added in future updates, and removes the project limit. Premium features are described inside the app and on the App Store listing and may change over time.
Premium is offered as an auto-renewing subscription with monthly and yearly options, purchased through Apple's App Store and charged to your Apple Account at confirmation of purchase. The price is shown in the app before you buy. Your subscription automatically renews for the same period at the same price unless auto-renewal is turned off at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the end of the current period. You can manage your subscription and turn off auto-renewal at any time in your Apple Account settings (Settings > Apple Account > Subscriptions). Any unused portion of a free trial period, if offered, is forfeited when you purchase a subscription. Purchases can be restored on other devices signed in with the same Apple Account using the "Restore Purchases" option in the app.
BoardTack may change the price of Premium at any time. Apple will notify you of a price change in accordance with App Store rules, and you may cancel before the change takes effect. Price changes do not apply to a subscription period you have already paid for.
In-app purchases and subscriptions are handled by Apple, and refund requests are subject to Apple's App Store refund policies. You can request a refund at reportaproblem.apple.com. Except when required by law, BoardTack does not issue refunds directly.
You retain all rights to the photos you edit with the Service and to the images you create with it. Because the Service processes photos on your device and does not upload them, BoardTack does not receive, store, or claim any rights to your content. You agree not to use the Service to create or distribute content that infringes the rights of others or violates applicable law.
The Service uses Apple's StoreKit for purchases and Google Firebase for anonymous analytics and crash reporting, as described in our Privacy Policy. When you share photos to Instagram or other apps, your use of those apps is governed by their own terms. Open-source components used by the Service are listed in the app under Settings > Open Source License.
The Service and its original content, features and functionality (excluding your photos) are and will remain the exclusive property of BoardTack and its licensors. The Service is protected by copyright, trademark, and other laws of both Korea and foreign countries. Instagram is a trademark of Meta Platforms, Inc.; PhoSplit is not affiliated with or endorsed by Meta.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind. We recommend that you keep your original photos; the Service saves results as new images and does not modify your originals, but we cannot guarantee that the Service will be error free or uninterrupted.
In no event shall BoardTack, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
